Bombshell discovery in WSMV4 investigation of sober drivers arrested for DUI Monday night at 6

NASHVILLE, Tenn. (WSMV) – A WSMV4 investigation has revealed how many Tennesseans have been charged with DUI who were fully sober at the time.

It’s the latest bombshell discovery in WSMV4’s ‘Serious Problem’ investigation.

One by one, WSMV shared their stories. Mothers who lost temporary custody of their children, fathers who lost their jobs and insurance. Case after case of sober drivers charged with DUI.

WSMV4 Investigates has now discovered just how often it happens.

Following the Sobering Problems investigation, the Tennessee Bureau of Investigation compiled all cases of people charged with DUI over a seven-year period who did not have alcohol or drugs in their system.

This lawsuit revealed that it happened to over 600 Tennessee citizens. The number of Tennessee drivers charged with DUI while fully sober was 609.

For perspective, if all sober drivers charged with DUI went to the Ryman, they would take up more than half the seats in the balcony.

WSMV4 shared these findings with Xavier Gray, the latest Tennessean found by the WSMV 4 Investigates team arrested for DUI whose blood tests show he was fully sober at the time.

“It’s a miscarriage of justice,” Gray said. “I knew there was nothing in my system. I thought I was a special situation, but it turns out I’m not.”

The first part of the data was collected at the request of State Representative Lowell Russell, who followed the WSMV4 Sobering Problems investigations.

Russell said one of his constituents was arrested for DUI and was also sober at the time.

The data doesn’t even include how often it happened in 2024. Gray’s arrest happened this year.

Even mothers against drunk driving call these cases “tragic.”
