During his emergency hearing appearance new york On Tuesday, Diddy’s attorney, Marc Agnifilo, accused prosecutors of a “complete institutional failure” that they say could have jeopardized the case.

Lawyers continued to argue that Diddy’s “constitutional rights” were violated after federal agents seized 19 pages of the rapper’s notes during a raid last month and shared them with prosecutors.

After hearing his argument, Justice Arun Subramanian directed the prosecution to temporarily destroy all copies of the documents.

The defense filed additional documents in court on Friday, saying they had just discovered prosecutors had confidential material from the Oct. 28 raid. This led to the emergency hearing.

Defense lawyers are currently investigating the event to determine the seriousness of the situation, Agnifilo told the court.

To determine what happened during the search, he added, the court must review the security tape from BrooklynThe Metropolitan Detention Center, where Diddy is being held.

Subramanian directed the Bureau of Prisons to preserve the video.

Diddy, who was arrested on September 17, was jailed pending trial for sex trafficking and transportation to engage in prostitution.

The rapper has denied all charges and is due to go on trial in May.
