A 43-year-old Lancaster County man has been arrested and charged with multiple felonies after police say he offered marijuana to a 13-year-old girl and sexually assaulted her last year.

The victim told her parents that she was sexually assaulted by Robert Fink Jr., of Columbia, in his apartment on September 9, 2023. The girl’s parents took her to speak with Columbia police the next day.

During the police interview, the victim said Fink’s girlfriend left the apartment around 8:00 p.m. and she and Fink went to his bedroom to hang out, where he offered her marijuana that made her feel “very high,” according to an affidavit.

After smoking marijuana, the victim said Fink began massaging her body before locking the door and performing sexual acts on her, police said.

During the abuse, Fink asked the victim, “Is she okay?” To which she replied, “No,” the affidavit said.

Fink then removed her pants and underwear, asked the victim if she was “decent enough” while referring to her genitalia and sexually assaulted her, according to the affidavit.

The 13-year-old was taken to Penn State Health Lancaster Medical Center for a sex forensic exam (SAFE). The test kit was taken to a Pennsylvania State Police laboratory on September 11, 2023.

The lab results of the SAFE kit came back on March 29, 2024, but the report noted that the DNA collected was from an unknown person, police said. Investigators issued a search warrant on Aug. 27 and obtained a buccal swab from Fink, which was sent to the PSP lab for comparison.

On Oct. 24, the PSP lab confirmed that Fink’s DNA matched samples collected with the SAFE kit, police said.

Based on DNA evidence, police charged Fink with legal sexual assault – 11 years or older, involuntary deviant sexual intercourse with a person under 16 years of age, unlawful contact with a minor, sexual assault, aggravated indecent assault, corruption of minors and indecent assault on a person under 16.

Finkwho is being held in the Lancaster County Jail as of Thursday, his bond was set at $500,000. A preliminary hearing is scheduled for November 19.
