With regard to trespassing on road widening projects, the Court stated that the following procedural safeguards must be met before taking action:

(i) To ascertain the existing width of the road in terms of official records/maps;

(ii) Conduct a survey/demarcation to ascertain whether there is any encroachment on the existing road with reference to the existing records/maps;

(iii) If a violation is found, issue adequate written notice to the infringers to eliminate the violation;

(iv) If the notifier raises an objection regarding the correctness or validity of the notification, decide the objection by an oral order, respecting the principles of natural justice;

(v) If the objection is overruled, give reasonable notice to the person against whom the adverse action is proposed and, if such person fails to act, proceed in accordance with law to eliminate the infringement, unless restricted by an order of the competent authority. authority or court;

(vi) Where the existing width of the road, including the State land adjacent to the road, is not sufficient to enable widening of the road, the State shall take steps to acquire the land in accordance with law before undertaking the road widening exercise.
