Logansport man arrested for intimidation, resisting law enforcement charges

The Logansport Police Department arrested a Logansport resident Tuesday on charges of intimidation and resisting law enforcement, among other charges, according to police reports.

On Nov. 5, Officer Joe Schlosser was dispatched to an apartment on George Street in reference to a battery, with a dispatcher reporting that the subject was injured and unresponsive. Upon arrival, officers found the apartment door ajar and initially heard no response after calling “the police,” according to the police narrative.

Officers then checked the basement laundry room where they found Nicodemo Gomez Lopez, 31, lying face down on the floor. They observed no obvious injuries, and he refused treatment or transport to the hospital.

A Fire Department translator told officers that Gomez Lopez said he was punched and dragged out of his apartment by a man named Francisco, for whom he could not provide a last name or physical description. His story later changed to say he wasn’t dragged out of the room and a knife was put on him, but he later said the knife was never used against him, according to the report.

Officers escorted Gomez Lopez back to his room, but while Schlosser was in his vehicle, Gomez Lopez reappeared outside and said Francisco was hiding under the bed. Upon searching, officers found no one under the bed and ordered the man to return to his room for the night.

Gomez Lopez reappeared as Schlosser was leaving the parking lot and nearly fell from the wobble into a retaining wall. Based on the training, Schlosser believed the man was under the influence of a narcotic and arrested him for public intoxication, according to the police narrative.

As Schlosser finished his shift, Officer Joshua Bennett conducted the transport for Gomez Lopez. While in the scanning and intake room, Gomez Lopez looked at Bennett and asked the officer if he knew how he was going to die, the police report said. He continued to make threatening remarks as jail staff informed Bennett that he would need to be medically cleared because he was refusing a preliminary breath test.

While at the hospital, Gomez Lopez continued to make threatening statements to Bennett and, after he was medically cleared, repeatedly looked at Bennett’s name strip on his uniform. Upon arrival at the Cass County Jail, Gomez Lopez passively resisted exiting the patrol vehicle, although he eventually complied and exited the vehicle.

As they made their way to the scanner and intake chamber, he attempted to back up and force himself away from the officer twice. The prison staff in the room did not speak Spanish, so Bennett offered to read Gomez Lopez’s questions. While reading the questions, the man tried to punch Bennett, but missed and hit the paper he was holding, according to the narrative.

Gomez Lopez was charged with two counts of intimidation, a Level 6 felony, one count of resisting law enforcement, a Class A misdemeanor, and public intoxication, a Class B felony. Bail was set at $1,000 in cash or at $5,000.
