Judge Juan Merchan is considering “throwing out” Trump’s convictions

The New York judge who oversaw of Donald Trump The Manhattan hush money trial is considering overturning its felony convictions after the former president won Tuesday’s election, CNN reported Wednesday.

The country’s 45th president he is due to be sentenced in the case on November 26, but whether the hearing will take place is now up to the judge Juan Merchan.

CNN Chief Legal Affairs Correspondent Paula Reid reported Wednesday night that Merchan will give himself until next week to decide whether it is appropriate to toss those convictions.

During CNN’s continuing coverage of the 2024 election, the network’s presentation Jake Tapper welcomed Reid to discuss Trump’s criminal case in New York. She reported:

I’m told his legal team will try to make sure the conviction never happens. As we know, their usual strategy is always to try to delay things. But here they will argue to the judge that the conviction should never happen because now that Trump is president-elect, they will say he is entitled to the same constitutional protections as a sitting president and should be protected from state actors and in this case, state prosecutors and the judge overseeing that case, Judge Juan Merchan.

He is giving himself a Nov. 12 deadline to decide whether the conviction against Trump should be overturned based on the Supreme Court’s recent ruling on immunity. If he throws the conviction, there will be no sentence. But if this sentence continues to go forward, that’s the argument that Team Trump will make.

Trump’s two federal cases are also expected to be dropped while he is special counsel Jack Smith wind them down. The previous former president he swore to fire Smith if he won the election. Regarding Trump’s RICO case in Georgia, CNN reported:

There is no clear answer as to whether a state prosecutor such as (Fulton County DA Willis fans), can prosecute a sitting president. Trump’s victory now forces Willis to confront this constitutional question on top of existing legal issues that have already cast uncertainty over the future of the Georgia case.
