Floridians are less than two weeks away from finding out if they can puff, puff and pass without needing a medical card.

After receiving approval from Florida Supreme Court earlier this year, voters will have a chance to vote for or against legalizing recreational marijuana on Election Day — Tuesday, November 5, 2024 — during the general election, otherwise known as the 3rd amendment.

Here’s when you can vote for the amendment and what happens if it passes.

Florida voters will see recreational marijuana on the Florida ballot as a initiated the constitutional amendmentknown as Amendment 3, Tuesday, November 5. Amendment 3 seeks to legalize recreational marijuana, allowing those 21 and older to possess up to 3 ounces and up to 5 grams of cannabis concentrate.

It still needs to receive a supermajority or 60% of the vote. Early voting for the 2024 general election began on Monday 21 October and ends on Sunday 3 November in some counties.

How soon could recreational marijuana become legal if amendment 3, the “recreational marijuana amendment” is passed?

Even if the amendment wins at the polls in November, marijuana won’t immediately become legal in Florida.

The process of passing a successful referendum into law can take several months. Even if it passes, the Florida Legislature must decide how to implement the law, including specific regulations on the amount of marijuana that could be purchased at any one time, potency limits, marketing rules and any other concerns that arise during the process.
