Trial set for four accused in alleged high school burglary – Mitchell Republic

MITCHELL — Four people will be arraigned Tuesday, Nov. 5 at the Davison County Public Safety Center during criminal court for an alleged burglary at Mitchell High School.

Elizabeth Dutchuk, 18, and Matthew Ruff, 19, both of Mitchell, and Spencer Spillman, 18, and Brandan Spillman, 19, both of Alexandria, were each charged with two counts of third-degree burglary in connection with the 26 September, 2024, incident. A police affidavit says an officer reviewed the tape overnight to identify people who may have been involved.

Mitchell Superintendent Joe Childs says the school district reported about $100 worth of drinks missing from a cooler in the cafeteria. A grand jury indicted the defendants on October 11 following the testimony of a Mitchell police detective. An arraignment is the formal reading of the charges to the defendant.

Burglary in the third degree is a Class 5 felony, punishable upon conviction by up to five years in prison and a $10,000 fine.
