The Prosecutor’s Office dropped the charge of attempted murder for a woman from kansas who allegedly shot her husband while they were vacationing at Pensacola Beach in October.

Jacqueline and Brian King They were on a family vacation with their children at the Fairfield Inn on Via De Luna Drive when she shot her husband in the chest during an argument.

Prosecutors initially filed a case against King on Oct. 8 for attempted second-degree murder. However, just days before her Nov. 1 arraignment, the prosecutor filed new charges.

According to Assistant State’s Attorney Greg Marcille, District Attorney Andy McGraw amended the indictment to two counts, transferring the case from circuit court to county court.

King is now charged with a first-degree felony count of improper display of a dangerous weapon or firearms and a second-degree felony count of using a firearm while under the influence of an alcoholic beverage.

Her next court appearance is scheduled for November 14.

What happened between Jacqueline King and Brian King?

During an interview with investigators, Jacqueline King said she and her husband had been arguing since leaving a bar in Pensacola Beach, and when they returned to the hotel she took her husband’s gun from the glove compartment and put it in her purse .

The argument continued as they were “getting ready for bed”, so Jacqueline closed and locked the bathroom door when Brian started banging on the door.

Once Brian King entered the bathroom, Jacqueline King said “the gun accidentally went off without her finger on the trigger.”

Jacqueline showed video footage of the deputy responding during one of the arguments, during which the wife can be heard saying, “You don’t have to touch me.”

Brian King replied, “Well, you say you’re going to kill me.”

Jacqueline and Brian King’s child corroborated the argument

Deputies arrived at the Fairfield Inn around 10:30 p.m. on Oct. 7, where they found Brian King “holding his chest with bloody clothing.” Before being airlifted to Sacred Heart Hospital, reports say Brian King claimed to have shot himself.

Jacqueline King’s arrest report notes that she said the shooting “was an accident” when deputies first made contact with her.

“I spoke with Jacqueline King and Brian King’s oldest child, … who is 8 years old,” the report said. “(The child) stated that he saw Brian King and Jacqueline King fighting in the bathroom and Brian pushed Jacqueline.

“Jacqueline King then took a gun from the mail, (the child) stated that the gun ‘misfired,’ and Brian King was shot,” the report added.
