BIRMINGHAM, Ala. (WBRC) – Birmingham police say 13-year-old Braylen Hardy has died after he died hit by a car over the weekend.

BPD says they have identified and questioned the driver of the car, but he is not in custody and has not been charged at this time.

“We will pursue available charges in this investigation,” BPD said. “Once you find that the driver didn’t intentionally hit someone, the investigator has to prove what facts in this wreck make this a criminal and not just an accident with just a civil lawsuit to come.”

Birmingham City Schools released the following statement Wednesday:

His family established a GoFundMe for funeral expenses.
