A Brockton judge on Monday granted bail for a man accused of raping a 15-year-old girl at a Rockland migrant shelter.

“Given the court’s assessment of the strength of the Commonwealth’s case, the nature of the offense charged, the defendant’s lack of ties to the community and his flight risk, the court finds that justice requires an increase in bail,” Judge Elaine Buckley ruled. at a hearing in Brockton Superior Court on Monday.

Cory Alvarez, a Haitian national, has pleaded not guilty in the rape of a 15-year-old girl staying at the Rockland Comfort Inn migrant shelter in March.

Alvarez was previously released on $500 bond, but was taken into ICE custody after his release. In the past week, prosecutors have been notified by ICE that they plan to deport the defendant back to Haiti on October 31st, prompting them to file a request to raise bail due to the impending deportation.

“Your Honor, Mr. Defendant, if the defendant is deported as scheduled on Thursday, this case will be frozen forever,” Plymouth County ADA Alex Zane said. “The 15-year-old victim involved in this case would never be able to face her accuser and have her day in court, and the defendant would never have the opportunity to clear his name in a jury trial, because he would effectively be barred from ever returning to the United States.”

ICE agreed to “honor the defendant who is being held on bond and delay deportation pending the conclusion of the case,” Zane said, requesting that bail be set at $1 million to hold the defendant.

The judge set bail at $150,000, ordering Alvarez to have no contact with the victim or her father and to wear a GPS if he posts bail and is released.

Zane also said ICE kept the DA’s office and the court “completely in the dark” about their plans, calling the situation “an unusual set of circumstances.”

“I also agree that it’s an unusual case, but it’s a little disturbing from the defense’s perspective that we’re not involved in the conversations they’re having with ICE,” said defense attorney Brian Kelley, noting that they have communicated and cooperated with the agency federal.
