Suspect arrested on attempted murder charge for allegedly shooting neighbor amid year-long dispute

Minneapolis police arrested a man early Monday morning on charges of attempted second-degree murder for allegedly shot his neighbor following a year-long dispute.

The arrest came after an intense standoff between a SWAT team and the suspect, John Herbert Sawchak, 54, who surrendered peacefully Monday, according to police.

Hennepin County District Attorney Mary Moriarty, whose office is prosecuting the case, confirmed to ABC News on Monday that Sawchak is in custody and being held on suspicion of attempted second-degree murder after allegedly shooting his neighbor, Davis Moturi, in the evening the month of October. 23, 2024.

“It was a very traumatic moment,” Moturi told ABC News in an interview Sunday from his hospital bed. “Just to realize that, you were hurt like that. Not only, not only shot, but shot in the neck and people are fighting to save your life. And you don’t know if you can make it.”

According to a probable cause statement obtained by ABC News, Moturi’s wife told police that her husband was shot while he was outside trimming a tree near the couple’s property line. The incident was caught on surveillance video that was obtained by ABC News.

The suspect allegedly told Davis Moturi, “Touch my tree again and I’ll kill you,” Moturi’s wife told police, according to the probable cause statement.

Police said the incident came after a year-long dispute between Moturi and Sawchak.

“The defendant has made numerous other threats and engaged in near-constant harassment of the victim and his wife since they purchased their home in September 2023,” the probable cause statement said, citing at least 19 other incidents of “vandalism, destruction/theft of property, harassment, hate speech, verbal threats and threats of physical assault” – the oldest of which dates back to October 2023.

“Right before (the shooting), it had a major impact on my life,” Moturi told ABC News, referring to the ongoing dispute with his neighbor.

According to charging documents obtained by ABC News, Sawchak faces three additional felony charges of stalking, harassment and assault.

Minneapolis Police Department Chief Brian O’Hara said during an early morning news conference Monday that there were multiple warrants for Sawchak’s arrest, but he stood up to police for four days and refused to come out of house.

“Minneapolis police have exhausted all efforts to resolve this situation peacefully, short of escalating the use of force with a SWAT team and special tactics,” O’Hara said.

“Fortunately, our officers were able to peacefully arrest this individual this evening after several hours of SWAT operation,” he added.

Attempts by ABC News to reach Sawchak directly were unsuccessful, and it is unclear if he has retained an attorney. Hennepin County District Attorney Mary Moriarty told ABC News on Monday that Sawchak is in custody and is scheduled to make his first court appearance Tuesday afternoon.

O’Hara said Monday that police had made “dozens of attempts” to arrest Sawchak since April, but “were unable to make contact with this individual.”

O’Hara admitted that law enforcement “failed” to protect Moturi in the case.

“We were unsuccessful,” O’Hara said of previous attempts to arrest the suspect. “And in that sense, yes, I failed. I failed this victim. He shouldn’t have been shot. But I will say this – we had no reason to suspect that he was going to shoot… the neighbor inside the house.”
