Philadelphia DA takes action on Elon Musk’s America PAC election ‘lottery’

There was a time in the not-too-distant past when Elon Musk said he intended to keep his wallet closed in electoral cycle 2024. The conspiratorial billionaire eventually changed his mind and began investing heavily in supporting Republican candidates up and down the ballot.

In fact, the richest man in the world even helped create a super PAC that, among other things, created a $1 million “lottery.” so: If you’re registered to vote in a battleground state and are willing to sign an America PAC petition, you could be picking up a seven-figure check, too.

If that doesn’t sound entirely legal to you, you’re not alone. Like my MSNBC colleague explained Lisa Rubinbecause federal law already prohibits paying anyone to vote or even register to vote, “a group of former GOP Justice Department officials even asked Attorney General Merrick Garland to open an investigation.”

We don’t know for sure whether or not this has happened or will ever happen, although the Department of Justice’s Public Integrity Section apparently contacted America PACwarning that these gifts may conflict with federal election law.

The Philadelphia District Attorney’s office has apparently taken it a step further. NBC News reported:

Philadelphia District Attorney Larry Krasner is suing Elon Musk and his super PAC to block his $1 million donation to registered voters, trying to stop the lottery-style stunt that election experts and the Department of Justices have warned that it could violate federal law. Krasner is seeking an injunction: He argued in a filing that the effort is an illegal, unregulated lottery, sidestepping the question of whether it violates vote-buying laws.

“America PAC and Musk are getting Philadelphia citizens — and others across the Commonwealth (and other swing states in future elections) — to give up their personally identifiable information and make a political pledge in exchange for a chance to win 1 million dollars. This is a lottery,” the suit claims. “And it is indisputably an illegal lottery. By unambiguous Pennsylvania law, all lotteries in Pennsylvania must be regulated by the Commonwealth of Pennsylvania.”

An attorney representing America PAC did not immediately respond to NBC News’ request for comment on the lawsuit.

Time will tell when and/or if a judge will set a hearing on the matter, though the district attorney is clearly banking on swift action. Watch this space.
