Three women injured when a tree in a neighboring yard fell on them in August are suing the property owner, alleging in a lawsuit filed Tuesday that failure to maintain the tree caused it to fall.

Danyelle Bushee was sitting in the driveway of her Orange home with her sister Brittany and their friend, Melissa Chiasson, when the tree fell on them and an SUV parked nearby, according to the women’s attorneys, Michael Kelly and John McCarthy.

Danyelle Bushee suffered a traumatic brain injury, broken vertebrae, fractured ribs and a broken femur, attorneys said in a statement. He spent two months in the hospital. She had worked as a nurse, but now needs round-the-clock care at home, along with extensive therapy, lawyers said.

Brittany Bushee was treated for three days at UMass-Memorial Medical Center for a skull fracture and brain bleeding, attorneys said. She “continues to suffer from memory and hearing loss, rendering her unable to work for the foreseeable future,” the lawyers said.

Melissa Chiasson suffered head abrasions along with shoulder and neck injuries that require physical therapy, attorneys said.

The tree fell from the house next door at 92 Mechanical St., which is owned by Peter G. Rocklin of Jersey City, NJ, according to attorneys and city assessment records.

Another tree had fallen from the property about six months earlier, attorneys said.

The women “experienced unimaginable suffering and pain due to the extreme negligence of Mr. Rocklin,” McCarthy said in a statement. “These injuries were caused by Mr. Rocklin’s negligent and reckless disregard for this presented danger. With basic maintenance and attention to the property, this was completely preventable.”

Rocklin could not be reached for comment.

When paramedics arrived, they believed Danyelle Bushee’s life was in danger and requested that she be airlifted to a hospital. The request was denied because of high winds, officials said.

“Danyelle (was) lying on her back with a large pool of blood surrounding her head and face,” police said in a report.

Brittany Bushee was sitting on the steps of the home struggling to stay conscious, according to the report.

“I observed a significant amount of blood coming from her head,” the report said. “He had difficulty speaking and kept closing his eyes as if he wanted to sleep.”

Because the life flight was canceled, the three women were taken to Athol Hospital, where they received initial treatment, attorneys said.
