New York lawmakers urge voters to reject Prop 1, citing concerns about expanded rights

A group of New York lawmakers is urging residents to vote against Proposition 1, a proposed amendment to the state constitution that would expand protections against discrimination based on factors such as gender identity, gender expression and national origin. In a joint statement, New York Senators Tom O’Mara, George Borrello and Pam Helming, along with Assemblymembers Phil Palmesano, Marjorie Byrnes, Chris Friend and Joseph Giglio, expressed concern that Prop 1, as advocates as an equal right. Amendment, it would have far-reaching implications beyond what is depicted on the ballot.

If passed, the amendment would add new classes protected under the state’s equal protection laws, with language intended to “dismantle discrimination” on various grounds, including reproductive health autonomy. However, opponents argue that this amendment could allow biological males who identify as women to compete in women’s sports and access women-only venues, potentially undermining the integrity of Title IX protections.

Critics also argue that the amendment’s “elimination of discrimination” wording could support policies such as reverse discrimination and reparations, while including “national origin” as a protected class could lead to benefits and voting rights for non-citizens. The proposal, they argue, omits specific wording on abortion access, despite advocates describing it as a measure to protect reproductive rights.

“The summary presented on the ballot is misleading and does not accurately reflect the language of the amendment,” the lawmakers said. They urge voters to fully review the proposition before voting and to “turn the ballot” to find Proposition 1.
