That Sean “Diddy” Combs continues to apply for bail ahead of his criminal trial, his lawyers accused prosecutors of using a deceptively edited video of an alleged The 2016 attack at a Los Angeles hotel.

The defense claims the prosecution “submitted an altered video that omitted key scenes and presented significantly irregular events.”

The video in question appears to be a surveillance video originally reported by CNNwhich appears to show Combs assaulting his exsinger Cassandra “Cassie” Ventura. The video was first mentioned in the September indictment against the music mogul and was later cited by the defense in two recent court filings reviewed by PEOPLE.

Although Cassie is not named in any of the court filings, the footage is listed as having been recorded in March 2016 at a hotel in Los Angeles, when the incident with the singer reportedly took place.

Combs faces federal charges of sex trafficking, racketeering and transportation to engage in prostitution. The indictment centers around “Mad Men” which prosecutors allege were sex shows staged by Combs in which women were forced or coerced to participate with male sex workers. He has denied all the allegations against him.

“The video is not evidence of coerced ‘crazy’ and sex-trafficking, but rather a sad look at a decade-long consensual relationship between the Combs,” the defense attorneys wrote.

Citing a defense expert’s analysis, Combs’ lawyers argue that the video presented by the government omitted “recordings corroborating the defense’s account” and that it changed the sequence of events.

The defense says Combs claimed that in the 2016 incident, he was trying to get his cellphone and clothes back.

Combs is due in court for a third bail hearing on Friday, November 22. He has been incarcerated at the Metropolitan Detention Center in Brooklyn since his arrest in December.

Two federal judges have already denied the music mogul bail, citing concerns he could tamper with witnesses.

In a reply to Combs’ third bail applicationprosecutors alleged that the Bad Boy Records founder tried to tamper with witnesses from behind bars, citing calls to the prison he made using other inmates’ access codes and conversations with various people, including his sons.

Combs’ attorneys proposed a $50 million bail package with strict release conditions. His trial is currently scheduled for May 2025.
