A pensioner was sent to court before Accra Circuit Court for impersonating deceased brother to sell land.

The police prosecutor, Chief Inspector Princess Tetteh Boafo, said the accused, Roland Ababio, allegedly posed as his deceased brother and with the help of his alleged accomplice, Kwame Gyane Ababio, who acted as an intermediary, facilitated the sale of the share of land

The two were charged with conspiracy to defraud and fraud by false pretense.

They apparently convinced a civil servant, Eric Kotey, to buy land at Teshie, falsely claiming it belonged to their deceased relative.

Details of the case

According to Chief Inspector Boafo, in November 2021, Kwame presented himself to Kotey, claiming that his “uncle”, Ephraim Asante, was looking for a buyer for a parcel of land he owned.

Kwame later introduced Kotey to Roland, who presented himself falsely as Ephraim Asante (deceased).

He allegedly confirmed Kotey’s identity and authorized Kwame to negotiate the sale on his behalf as he prepared to leave for United States of America.

The two agreed to sell the land for GH¢450,000 with Kotey transferring an initial payment of GH¢250,000 into Kwame UBA bank account.

However, at a visit to the propertyKotey discovered that Kwame was developing the land for another family member.

When questioned, Kwame could not provide a convincing answer, prompting Kotey to report the matter to the police in May 2022.

Police investigations confirmed that the land originally belonged to Ephraim Asante, who died in 2016.

The prosecutor said Ababio and Kwame exploited Asante’s death to sell the land to Kotey, collecting an advance of GH¢250,000 from Kotey.

It was also discovered that part of the land sold to Kotey belonged to another entity, Daraja Properties.

During the investigationKwame repaid GH¢130,000 of the GH¢250,000 advance paid by Kotey.

Arrest warrant

The presiding judge, Susana Eduful, granted Ababio bail of GH¢200,000, requiring two sureties.

Guarantors must prove that they own assets equal to the amount of the bond. In the meantime, the original title documents are kept at the registry office until the case is resolved.

However, due to Roland’s failure to appear in court, the judge issued a warrant for his arrest.
