Sean “Diddy” Combs The legal team claims a recent search of the music mogul’s jail cell violated his right to attorney-client privilege.

Diddy, 55, is currently incarcerated at the Metropolitan Detention Center in Brooklyn while he awaits trial on federal sex-trafficking charges. Days after prosecutors argued in a motion Friday, Nov. 15, that Diddy tried to obstruct an investigation contacting witnesses while in jail, Diddy’s lawyers responded.

“Defense counsel recently learned that prosecutors are in possession of privileged attorney client materials, including the defendant’s written notes. This search and seizure violates Mr. Combs’ rights under the Fourth, Fifth, and Sixth Amendments,” the lead attorney said. Mark Agnifilo argued in a letter filed Monday, Nov. 18.

In court documents obtained by We weeklyAgnifilo asked Judge Arun Subramanian for an “immediate evidentiary hearing” to investigate the search, which he called a “targeted seizure” amounting to a “substantial violation of due process.” He asked to determine “who authorized the search of Mr. Combs’ sleeping area, personal effects and documents” and “who determined which documents” were to be turned over to the United States Attorney’s Office.

Agnfilo also claimed that Diddy’s legal team did not know that the musician’s written notes were taken from his cell and given to prosecutors until the prosecution filed a motion on Friday accusing Diddy of trying to influence the outcome of his trial. Prosecutors cited an analysis of Diddy’s recorded calls in Friday’s legal filing, alleging the rapper made “hundreds” of calls and texts in violation of prison rules by using phone accounts belonging to other inmates.

“Since defendant was detained at MDC, he has continued to attempt to evade law enforcement surveillance, corruptly influence witness testimony, and further attack the integrity of those proceedings,” according to court documents obtained by CNN. “While attempting to evade law enforcement surveillance, the defendant orchestrated, among other things, social media campaigns that, in his own words, were intended to taint the jury; has made efforts to publicly disclose materials it considers useful to its case; and contacted witnesses through third parties.”

Diddy was arrested and charged on charges of sex trafficking, racketeering, conspiracy and transportation to engage in prostitution in September. A 14 page indictment accused him of hosting “elaborate and produced sexual performances” called “Freak Offs” and alleged that he used “force, threats of force, and coercion to induce victims to engage in extensive sexual acts with commercial male sex workers.”

Diddy has pleaded not guilty and denied the charges against him. He has since been denied bail three times. The prosecution made their recent claims about Diddy trying to “corruptly influence” the outcome of his trial when they argued that his fourth bail application should be rejected.

Diddy and his legal team proposed the new $50 million bail package earlier this month, arguing that he should be allowed to prepare for his May 2025 trial outside prison because of changed circumstances and new evidence. The filing proposed a “much more robust” bail package, with house arrest, permanent security monitoring and restrictions on Diddy’s ability to contact anyone but his legal team. A decision on the fourth release attempt has not yet been issued.
