MOBILE, Ala. (WALA) – FOX10 News gets answers about private ankle monitoring company under fire.

The company, Accupoint, is accused of failing to monitor a mobile man on murder bail who allegedly committed another crime last week.

According to court documents, Nyyon Sanders was out on bond for a 2022 murder and was wearing an ankle monitor.

Documents say he let his battery die before shooting and killing Joseph Evans Jr. at Dauphin Gate Apartments.

Now, Accupoint supervisors Jennifer and Bill Vallon are telling their side of the story.

Vallon says they have been monitoring Accupoint since October 2023 and currently have 63 people in the system.

Jennifer says there’s more to the story than what’s being said and says she was heartbroken when she heard the news of the latest murder.

“This is a heartbreaking circumstance. If I could have kept him charging his watch, if I could have stopped this, if I could have shown up at his house, I would have,” said an emotional Jennifer. “I can’t imagine what the family is going through right now.”

Jennifer says she started getting notifications last Monday that his watch was dying.

“When it started dying, I sent out multiple alerts saying your watch is dying, put it on a charger,” Jennifer explained. “As it approached, there were critical warnings buzzing louder on the clock. We start calling, sending messages. We’re trying to get in touch with that person to let them know they’ve violated.”

Jennifer says that once they’ve done everything they can to contact a violator, they don’t have the authority to decide what happens next.

“Unfortunately, our hands are tied. We can’t go and arrest them at that moment when their clock is dying. We tried to ask what we can do and the only thing we can do is send a report,” she said. “Usually we’ll contact the bonding company and we’ll contact the DA’s office. But we don’t have the authority to go and pick them up because then we’ll be accused of kidnapping.”

Jennifer and Bill say they have both made numerous attempts to resolve this matter and have even contacted the DA’s office.

The Vallons say no one will get back to them or tell them what the proper procedure is.

“I’ve tried to communicate with Mr. Blackwood too many times to count, he still hasn’t met with us,” Jennifer said. “And now he says this is our fault? Or that I did not monitor? I mean they have to go back on him because he could have given us a new protocol at any moment.”

FOX10 News reached out to the district attorney’s office Thursday night to ask about the communication and was told, “The DA spoke personally with someone from Accupoint.”

The company also came under scrutiny last month when a Mobile defendant violated the terms of his release by going to a casino in Mississippi.

The judge will not use the electronic monitoring company accused of not reporting the violation

Jennifer and Bill say they don’t want to see anything like that again.

Bill tells FOX10 News if something doesn’t change soon, they will be closing.
