The Supreme Court urges the Center to establish a rehab framework for sex trafficking victims

The Court hears a request requesting compliance with 2015 decision which noted the Center’s position on the formation of the Organized Crime Investigation Agency (OCIA) and the strengthening of the Victim Protection Protocol for victims of sex trafficking.

In this order, the Court also urged the Union to consider adopting a comprehensive framework for the rehabilitation of these victims.

With regard to the formation of the OCIA, the Union informed the Court through its earlier statement that in lieu of such formation, amendments were made to the National Investigation Agency (NIA) Act, 2008 to deal with the issue.

However, the Court raised concerns that the amendments to the NIA Act may not adequately address victim protection, as it may at best prosecute sex-trafficking offenders but fail to protect victims.

“While preventing human trafficking, along with prosecuting and punishing the perpetrators of such heinous crimes is important, it is equally important that legislative mechanisms focus on providing care, protection and rehabilitation to victims of trafficking. to be achieved by creating a wider legal, economic and social environment that ensures the well-being of victims. A human rights and rehabilitation approach to these crimes is needed. the Court pointed out.
