A man from St. Albans pleads guilty to child neglect after child ingested meth

A man from St. Albans whose child was found unresponsive after ingesting meth while the father slept has pleaded guilty to multiple charges.

David Mallo, 27, pleaded guilty to one felony and three misdemeanors during a hearing Wednesday in Kanawha County Circuit Court.

Mallo pleaded guilty to child neglect causing serious bodily injury, a felony, as well as two counts of child neglect creating a substantial risk of bodily harm and one count of simple possession of methamphetamine, also a misdemeanor.

The two counts of child neglect were lesser included offenses of the felony charges of gross child neglect creating a substantial risk of serious bodily injury or death for which he was originally charged. There were two other children in the house who did not ingest the drugs.

Two other charges related to marijuana and obstruction were dismissed as part of the plea.

“I messed up. I was doing the best I could and taking care of three kids as a single father. I had some people come to the house and I ended up relapsing,” Mallo told Judge Maryclaire Akers. “I took a nap and when I woke up, I found my baby as it was and I was scared.”

Mallo said she initially thought the child, a 5 month old boy, he had sunstroke. He said he called an ambulance that took the child to the hospital, where he was placed in a medically induced coma and put on a ventilator.

Assistant District Attorney Madison Tuck said the child also had several seizures, including one that lasted 17 minutes.

The child tested positive for methamphetamine after being brought to the hospital with a temperature of 105 degrees, police said. The child was later airlifted to a Huntington hospital and is now recovering well, according to prosecutors.

Prosecutors noted that Mallo had a prior conviction for misdemeanor endangerment. He is also charged with being a prohibited person with a firearm in a separate case that prosecutors said is being considered for federal authorities.

He faces one to 10 years in prison on the child neglect charge when he is sentenced on Jan. 8. He also faces up to six months in prison for each of the three misdemeanors to which he pleaded guilty.
