Samantha, who has a father with Meghan, initially filed a defamation lawsuit in 2022 against Meghan, claiming the duchess had made “despicable, hurtful and false” remarks in her interview with Oprah Winfrey and the documentary series Harry & Meghan ” from Netflix.

Samantha’s lawsuit alleges that Meghan described her as “an outsider, a liar and a … deceitful fame-seeking impostor with stingy intentions,” which Samantha says damaged her reputation.

Meghan’s legal team defended her statements, arguing: “An implied or express statement that (Samantha) belongs to a hate group that spreads misinformation about Meghan is an opinion protected by the First Amendment.” Meghan won the original case; however, Samantha has since appealed the ruling, taking the case to the 11th Circuit Court of Appeals.

Samantha’s lawyer Peter Ticktin argued: “There can be no doubt that Meghan Markle verbally attacked her sister Samantha Markle in her documentary.” Ticktin claimed Samantha, who uses a wheelchair, faced severe backlash from Sussex supporters and had to move for safety.

At the heart of Samantha’s case is a scene from the Netflix documentary in which Christopher Bouzy, a friend of Meghan and Harry, discussed the intense online harassment Meghan suffered from “people who were just not your typical trolls without quotation marks”.

“These are housewives, these are middle-aged Caucasian women,” Bouzy said, and claimed that “Samantha Markle was part of the group that spread a lot of this misinformation.”

“You make people want to kill me.” It’s not just a tabloid. It’s not just a story. You scare the crap out of me,” the scene concluded.

Ticktin claimed that “(Samantha) has never been part of a disinformation group, has not trolled Meghan, has never been a part of any hate group, has never used the N-word on tweets, has never monetized has never tweeted hate against Meghan or done anything to make anyone want to kill Meghan or make Meghan angry because of such activity.”
