Immigration and Customs Enforcement (ICE) arrested another illegal immigrant accused of child sex crimes in Boston, just as Massachusetts’ governor said he would not stand by a mass deportation operation by the incoming Trump administration.

ICE Enforcement and Removal Operations (ERO) Boston announced this month that they apprehended an illegal immigrant from Colombia on October 29. He was arrested by the Boston Police Department on charges of solicitation of a child under 16, distribution of obscene and lewd material. posing and exposing a naked child.

ICE filed a detainer — a request that an illegal immigrant be detained until ICE can take him into custody — but the detainer was not honored by local authorities and he was released from custody. The man, Mateo Hincapie Cardona, was met in April by Arizona Border Patrol and released on his own recognizance.

“This individual is accused of committing heinous crimes against a child that show he is a distinct threat to our Massachusetts community,” said Patricia Hyde, acting director of ERO’s Boston office.

It’s one of several incidents that have seen the Boston ICE unit search for illegal immigrants released from local custody in the city and surrounding areas. “Sanctuary” jurisdictions typically do not honor ICE detainers, arguing that this encourages illegal immigrants to come forward and work with police if they are victims or witnesses of crimes. Massachusetts is not a sanctuary state because it does not have a sanctuary law on the books, but a number of its cities — including Boston — are sanctuary cities.

Mateo Hincapie Cardona, 28, is currently in custody pending removal proceedings.

In August, ICE arrested a Brazilian illegal immigrant in Wakefield, Massachusetts, who was charged with assault to the point of rape, indecent assault and battery, and domestic assault and battery in Massachusetts.

A law enforcement source confirmed to Fox News that despite having an active warrant for his arrest for domestic violence, the local bail commissioner allowed him to be released back on bail.

In March, Fox News embedded with ICE officers in Boston and saw them make five arrests, including four alleged child rapists and a member of MS-13, a group of potentially dangerous criminals who officers say were let out on streets due to local sanctuary policies. which rejected the agency’s claims for possession.

While ERO Boston Field Office Director Todd Lyons praised the work of local officers to take potential threats to the community off the streets, he acknowledged the sanctuary policies in Boston they are “frustrating” and make it harder for the agency to do its job.

But these sanctuary policies will likely come into greater focus with the incoming Trump administration.

President-elect Trump has promised a mass deportation crackdown and this week named former ICE Acting Director Tom Homan as the “border czar.”

Massachusetts Governor Maura Healey said state police would “absolutely not assist” agents in their deportation operations and hinted at potential pushback against the administration.

“Some realities need to be noted, and this in 2016, we had a different situation in the courts and I’m sure there could be litigation ahead. There are many other ways that people will and must act for the sake of the states and their residents,” Healey said. “There is regulatory authority and executive powers and the like. There is legislation in our state as well.

“So I think the key here is that, you know, every tool in the toolbox has to be used to protect our citizens, to protect our residents, and to protect our states, and to hold the line on democracy and the state of justice. a basic principle”.

A source at ICE Boston was not impressed with Healey’s comments.

“Governor Healey’s sanctuary policies protect criminals and put law enforcement officers at risk every day,” they said. “Her policies do not protect the citizens of the communities to which she has sworn an oath.”
