New process for approval of unlicensed equipment exempt from license

The Office of the Commissioner of Customs, Chennai-IV has issued Public Notice No. 55/2024 on the approval process for license-exempt unlicensed equipment devices. Following CBIC Instruction no. 24/2024-Customs and a recent Office Memorandum of the Department of Telecommunications (DoT), Equipment Type Approval (ETA) for these devices can now be granted on a self-declaration basis. Importers and other interested parties can submit ETA applications through SARAL Sanchar portal along with necessary documents and fees. After submission, applicants can download their ETA certificates from the portal. However, ETA holders must obtain a No Objection Certificate (NOC) or other clearances from the Directorate General of Foreign Trade (DGFT) before importing the equipment. They must also ensure full compliance with all import regulations and requirements as mandated by the DGFT. This new process replaces certain aspects of the previous Council Instructions (No. 16/2022-Customs). For implementation issues interested parties may contact Chennai Customs office through the email provided. This notification also serves as a standing order to the officers of the Commissionerate of Exports Chennai-IV.

Sub: Issuance of Equipment Type Approval (ETA) for License Exempt Wireless Equipment Devices – Reg.

The kind attention of importers, customs brokers and all other interested parties is invited to CBIC Instruction No. 24/2024- Customs of October 22when 2024 and reference is also invited to the Memorandum of the office of WPC Wing, Department of Telecommunications (DoT), Ministry of Communications, issued vide R 11017/01/2018-PP (part 1) dated 09-09-2024 regarding the issuance Equipment Type Approval (ETA) for license-exempt equipment devices (copy attached) as an ease of doing business in the telecommunications sector.

2.1 Pursuant to the OM, it is hereby conveyed that all applications for Equipment Type Approval (ETA) for wireless equipment devices which have been exempted from license by various Gazette notifications issued from time to time shall be granted to the applicant on a self- statement basis.

2.2 In order to avail this facility, it is stated that, the applicants are required to submit the applications on the SARAL Sanchar portal (with all the necessary documents and fees. After the successful submission of the application, the applicants can download the ETA certificates from the portal.

3. It was also clarified in the said OM that these ETAs will be granted to ensure compliance with RF regulations. Therefore, ETA holders must obtain the No Objection Certificate or other authorizations (if applicable) from the Directorate General of Foreign Trade (DGFT) before importing the equipment. It is the sole responsibility of ETA holders to ensure compliance with all regulations and import requirements stipulated by the DGFT.

4. Previous Council Instructions no. 16/2022-Customs dated 21.07.2022 stands modified to this extent.

5. Difficulties, if any, in the implementation of this Public Notice may be brought to the notice of the Commissioner of Customs, Chennai-IV Commissioner (Export), Customs House, Chennai through e-mail. (email protected).

6. This public notice will serve as a standing order to the officers of Commissioner Chenni-IV(Export)-ate.
