Man accused of sexual assault in Shelby Twp. Walmart

A Macomb County man accused of sexually assaulting a woman last month at a Shelby Township Walmart has been charged, officials said.

Kirk Rogers, 58, of Roseville, was arraigned last week in Shelby Township 41-A District Court on a charge of second-degree criminal sexual assault, police said Wednesday.

A magistrate set his bond at $500 and scheduled his next court appearance for next Tuesday, according to police and court documents.

If convicted, he faces up to five years in prison.

Reached Thursday, Rogers’ attorney, William Barnwell, said in a statement: “My client will not be convicted of a second-degree criminal sexual conduct charge. This case was initially overcharged and my client looks forward to defending himself against these charges in court. .”

He also noted that the court determined his client’s bond was set at $5,000 and a 10 percent deposit was required.

Police said that on Oct. 23, officers were called to the Walmart store at 51450 Shelby Parkway near 23 Mile Road and M-53 for a report of a man who sexually assaulted a woman while she was shopping.

Investigators said the victim told officers she saw the man leave the store after he left and before police arrived. She told them the suspect got into a silver Jeep Patriot.

Detectives said they examined store security cameras to find the suspect’s vehicle and used license plate reader technology to develop Rogers as a suspect. They also learned that Rogers had previously been arrested for criminal sexual conduct.

According to the Michigan Sex Offender Registry, Rogers was convicted of fourth-degree criminal sexual conduct with a victim between the ages of 13 and 15 in Macomb County in 2011.

“I want to thank our officers and the Detective Bureau for their quick work in locating this despicable individual,” Shelby Township Police Chief Robert Shelide said in a statement. “I am pleased that Shelby Township Police were able to get this vile man off the streets before he could offend again. This is a person who has been investigated and arrested multiple times for assaulting young women and needs to be stopped from doing it again so the residents of Shelby Township can feel safe and protected from this type of monster. “
