Colorado’s new hands-free law extends to 2025

COLORADO SPRINGS, Colo. (KKTV) – Starting Jan. 1, it will be illegal for drivers to hold their phones in their hands or otherwise use a mobile device while driving.

The Colorado Department of Transportation said that while drivers cannot use or hold mobile devices, hands-free accessories would still be allowed. These accessories include CarPlay, Android Auto, car speakerphones, dash mounts and Bluetooth headsets.

“The new law expands the ban on cell phone use beyond just texting,” CDOT said. It now includes holding or manually using a telephone or other mobile device for voice calls or any other reason, requiring all drivers to use a hands-free device.”

CDOT said this law still applies to people sitting at traffic lights or in traffic.

Punishment for violating the law would start with a $75 fine and two license suspension points for the first offense, and repeat offenders could have more points and higher fines, according to CDOT.

CDOT said a first-time violator can have the charges dismissed if they show proof of purchase of a hands-free accessory.

This law exempts emergency responders, utility workers, code enforcement officers, animal welfare officers, persons with a commercial driver’s license operating a commercial vehicle, first responders, and persons in parked vehicles. CDOT said the reason for the exemptions was so emergency workers could receive critical information.
