3 indicted by Cuyahoga Grand Jury in Cleveland police shooting

CLEVELAND, Ohio – A Cuyahoga County grand jury has returned an indictment charging three people with attempted murder for shooting Cleveland police officers.

Police said on Oct. 28, Ray Agosto, 32-year-old Wayne Agosto, 25-year-old Dakota Greene and 31-year-old Dylan Mitchell were near Denison Avenue and West 31st Street in Cleveland when CPD officers who were already in the area were looking for Ray Agosto, 39, for an incident involving his downstairs neighbors a few days earlier.

According to police, Wayne Agosto fired multiple shots at the officers and the officers returned fire. Ray Agosto and Dakota Greene fled the scene. Wayne Agosto and Dylan Mitchell were arrested at the scene.

Wayne was taken to a nearby hospital after being shot by police.

“I am thankful that the Cleveland officers were not injured while trying to apprehend Ray Agosto,” said District Attorney Michael C. O’Malley. “These gun-toting, violent predators don’t have a care in the world for our community, and I’m glad they’re off our streets.”

Police said Ray Agosto approached the neighbors again on Oct. 28, saying he had forgotten his keys. When he opened the door, Agosto had a gun in his hand and a knife on him. He tried to punch her in the face but it hit the wall. The victim’s husband heard Agosto and closed the front door. Agosto fled the scene.

Later that day, Ray Agosto, Wayne Agosto, Dakota Greene and Dylan Mitchell were near Denison Avenue and West 31st Street in Cleveland. CDP officers were already in that area actively searching for Ray Agosto regarding the above incidents. Wayne Agosto then fired multiple shots at the officers and the officers returned fire. Ray Agosto and Dakota Greene then fled the scene. Wayne Agosto and Dylan Mitchell were arrested at the scene and Wayne was transported to a nearby hospital to be treated for his injuries.

Dakota Greene was later located at an apartment complex and arrested.

The next day, near West 131st Street in Cleveland, Ray Agosto was arrested after a two-hour standoff with the Ohio US Marshals Service’s Violent Fugitive Task Force, the Cleveland SWAT team and CPD.

The investigation is being conducted by CPD and is ongoing.
