Court debates possible intellectual disability for man convicted of killing Panola County deputy

LONGVIEW, Texas (KLTV) – The defense continues its case in Gregory Newson’s penalty trial. He was convicted in the 2019 slaying of Panola County Deputy Chris Dickerson.

The state is seeking the death penalty, while the defense is asking the jury to sentence Newson to life in prison without parole. These are the only two options for a capital murder sentence in Texas.

The defense called one of Newson’s childhood friends to testify. He discussed growing up with Newson, describing him as “a joker”. He detailed how they often witnessed police violence in their neighborhood.

Dr. Antoinette McGarrahan took the stand for the defense. She interviewed Newson and analyzed his mental background. She testified that Newson has a full-scale IQ of 79, which is in the bottom 10% of the population. She concluded that Newson has an intellectual disability.

McGarrahan noted that Newson has shown academic difficulties on her testing in the past as well. She said she has speech and memory problems. He did well on non-verbal testing, which the state cross-marked.

The defense alluded to Atkins vs. Virginia, a Supreme Court case that prohibits the execution of people with intellectual disabilities. The state will provide its own psychologist to counter the defense.

Ultimately, the jury will decide whether or not Newsom has an intellectual disability.
