(NewsNation) — A federal grand jury in New York will hear new evidence in the case against Sean “Diddy” Combs Thursday that could lead to a substitution indictment.

NewsNation has confirmed that a grand jury in the Southern District of New York will hear new testimony from a man regarding the Combs investigation.

It is unclear whether the testimony will be before the same grand jury or a new one.

Attorney Ariel Mitchell-Kidd confirmed the witness is her client NBC News.

Where is Sean ‘Diddy’ Combs?

Attorneys for Mitchell-Kidd and Combs did not immediately return a request for comment from NewsNation.

Any new evidence could lead to a replacement indictment which could add more fees.

Combs pleaded not guilty to federal sex trafficking charges contained in an indictment the day after his Sept. 16 arrest. The charges include allegations that he coerced and abused women for years, aided by associates and employees, and silenced victims through blackmail and violence, including kidnapping, arson and physical beatings.

He remained jailed pending a May 5 trial after two judges denied bail in rulings that were appealed to the 2nd U.S. Circuit Court of Appeals.
