Rochester roofing company fined for safety violations at Newark construction site

Elmer W. Davis Inc., a Rochester-based roofing company, is challenging a $16,782 fine following a judge’s ruling regarding safety violations during a municipal building project in Newark.

The US Department of Labor’s Occupational Safety and Health Administration (OSHA) cited the company for two serious violations, including inadequate fall protection and unsafe use of ladders, according to the Finger Lakes Times.

OSHA inspectors found that an employee was exposed to a 40-foot fall risk while operating a crane near the building’s roof without proper fall protection. The ruling, issued Sept. 19, upheld those appeals after the company’s employee misconduct defense and Fourth Amendment protections were dismissed.

Elmer W. Davis, which appealed the decision on Oct. 18, maintains that its safety record is exemplary, noting that OSHA inspections have rarely resulted in citations over the past decade.
