Here’s how Nevada plans to keep elections safe amid voter concerns

CLARK COUNTY (KTNV) — The 2024 presidential election is just over a week away and crowds of people still gather at polling stations during the early voting period in Clark County.

Many viewers told channel 13 about the concerns they have with the electoral process.

These concerns include double voting, fears of voter violence, and even concerns about campaigning and voter intimidation.

I have brought your concerns to Secretary of State Cisco Aguilar.

“You can never be 100 percent safe, but at the same time you can definitely take steps to do the best you can,” said Xan Clancy, who submitted her mail-in ballot at the Desert Breeze polling station from the southwest. moon valley

Clancy left her ballot with Jonathan Nelson.

“At least I feel a little more confident that I was able to fill it out in the privacy of my own home, but I come here and leave it in a safe place,” Nelson said.

Despite some of their concerns, both told me they feel confident in the state’s ability to keep elections fair and secure.

“Nevada runs some of the safest elections in the country,” said Sec. Aguilar.

Aguilar told me Monday that there are several state laws and safeguards in place to prevent these voter concerns and ensure voter integrity.

“Every mail-in ballot in Nevada has its own code, so we know that code is only assigned to one ballot, so we can track it across the 17 counties,” said Sec. Aguilar. “And if they vote in person first, and then you try to mail in (a) ballot, when the mail-in ballot is received by the county, it is flagged and placed in a special status for review and investigation. “

Here is Nevada’s Double Voting Law:

NRS 293.780 Voting more than once at same election.

1. A person entitled to vote may not vote or attempt to vote more than once in the same election. Any person who votes or attempts to vote twice at the same election is guilty of a Class D misdemeanor and shall be punished as provided in NRS 193.130.

2. The notification of the provisions of subsection 1 must be made by the county or city clerk as follows:
(a) stated on all sample ballot papers distributed by post or electronic means;
(b) Displayed in bold type at each polling station; and
(c) Posted in bold type in the county or city clerk’s office.

Sec. Aguilar told me voters must either turn in their mail-in ballot or sign a form saying they won’t fill out their unused ballot if they vote in person.

Election officials will mark the ballot as void and dispose of it properly if you choose to turn it in in person.

Here is the state law regarding mail-in ballots:

NRS 293.269917 Mail-in voting procedure; personal voting procedure after the postal ballot sent to the voter.

1. Unless otherwise provided in NRS 293.269919 and chapter 293D of the NRS, to vote a postal ballot, the voter must, in accordance with the instructions:
(a) Mark and fold the postal ballot;
(b) Place the postal ballot in the return envelope and seal the return envelope;
(c) put his signature on the return envelope, in the space provided for the signature; and
(d) Mail or deliver the return envelope in a manner authorized by law.

2. Unless otherwise provided in chapter 293D of the NRS, voting must take place only for candidates whose names appear on the postal ballot as prepared in accordance with NRS 293.269911and no one may write on behalf of an additional candidate for any office.

3. If a mail-in ballot has been sent to a voter requesting to vote in person at a polling place, including but not limited to an early voting polling place, the voter must, in addition to complying with all other requirements for voting in person that are mentioned in this chapter, submits his or her ballot by mail or signs an affirmation under penalty of perjury that the voter did not vote during the election. A person who receives a surrendered postal ballot will mark it “Cancelled”.

As for the direct campaign to voters at the polls – known as electoral — must be done more than 100 meters away from the entrance to the polling station.

As long as they meet the distance requirements and do not use force, intimidation or cause violence in any way, they are perfectly legal and can support their candidate.

Sec. Aguilar said our state has an Election Task Force made up of federal, state and local law enforcement that work together to stop any violence and ensure that Nevada’s voting process is safe even after the polls close.

Early voting takes place until Friday, November 1. You can also vote in person on Election Day, November 5.
