Longmont man accused of causing 2023 crash accepts plea deal

A Longmont man who allegedly drove while intoxicated and caused a three-vehicle crash in 2023 has taken a plea deal and is scheduled to be sentenced Monday, according to the Boulder County District Attorney’s Office.

Douglas Potter, 35, was arrested on suspicion of two counts of vehicular assault – reckless driving; two counts of vehicular assault – DUI; possession of firearms under the influence of alcohol; DUI; driving without insurance; possession of an open container of marijuana in a vehicle and displaying expired plates.

Potter pleaded guilty Tuesday to first-degree assault and DUI — per se, according to Boulder County District Attorney’s Office spokeswoman Shannon Carbone. All other charges were dismissed.

He is scheduled for sentencing Monday at 10:30 a.m., according to Carbone. One of the terms of the plea deal was 12 years in prison, Carbone said.

Potter was injured in a three-vehicle crash involving five people — including one who was trapped in one vehicle — on June 11, 2023, near Ken Pratt Boulevard and South Hover Street, according to an affidavit . One person was trapped in a vehicle

The Longmont Fire Department extinguished the fire and extricated the driver from the vehicle, according to the affidavit.

Police found Potter unconscious in a Lexus that was on its side. He was taken to UCHealth Longs Peak Hospital.

Witnesses told police they saw the Lexus traveling at a high rate of speed and also saw the vehicle roll over the center median and collide head-on with a Dodge truck.

On the day of the accident, Potter said he was playing paintball at the American Paintball Coliseum in Denver and said he left around 4 p.m. to head to Longmont. He also said he had been drinking at the facility and “didn’t provide an amount, but indicated that it’s a big thing in paintball not to drink a lot,” according to the affidavit.

Potter told police he had an AR-15 rifle and two handguns in the car with him because he was going to shoot. But because of the weather, he couldn’t go. Police found various types of ammunition scattered at the crash, the three firearms and marijuana concentrate, according to the affidavit.

Officers noted that Potter’s blood alcohol content was 0.178, more than twice the legal limit.
