Trump calls for “immediate retraction” of New York hush money case

President-elect Donald Trump requests “immediate dismissal” a new york hush money case, in which a jury found him guilty of 34 counts of business falsification, citing the “uniquely destabilizing” effects of convicting a future president.

“While DA Bragg engages in his own campaign, (the Manhattan District Attorney’s Office) appears not yet ready to dismiss this politically motivated and fatal case, which is what the law requires and will happen as justice he will take his of course,” Trump’s lawyers wrote in a letter at Judge Juan Merchan on Wednesday.

Trump’s response comes a day after Manhattan District Attorney Alvin Bragg informed Merchan that he did not oppose a delay in post-trial proceedings, indicating that his office would not oppose a postponement of his Nov. 26 sentencing. But Bragg’s office has made it clear they don’t think the case should be dismissed and even offered the option of convicting Trump after the end of the second term in 2029.

Defense attorneys pointed to special counsel Jack Smith’s recent plans to resign and dismiss the two federal criminal charges against Trump as the reason the state criminal case — in which Trump was accused of falsifying business records to hide a payment of 130,000 dollars made to the porn star. Stormy Daniels in the run up to his 2016 presidential run – should also be dumped.

Trump has pleaded not guilty to the charges and denies Daniels’ allegations that they had an affair.

“However, it appears that the DOJ is preparing to dismiss the federal cases against President Trump and will report its final decision to the federal courts on December 2, 2024. As in those cases, dismissal is required here,” Trump’s lawyers wrote.

Merchan has yet to erase the Nov. 26 sentencing date from the schedule, but it will be up to him to first rule on Trump’s final motions to dismiss the case.

Trump tried and failed several times to dismiss the case before the trial ended, including efforts to take the case to federal court in a bid for a more favorable venue given Manhattan’s Democratic-leaning demographics.

The president-elect even suggested on several occasions that Merchan could not judge the trial without bias, in light of his daughter Lauren Merchan’s work for a political consulting group that works on behalf of numerous Democrats, including Rep. Adam Schiff (D-CA). Merchan also denied those efforts to dismiss the case.
