Man who attacked woman in Ann Arbor apartment pleads no contest

WASHTENAW COUNTY, MI – A man has pleaded no contest to assaulting a woman at an Ann Arbor apartment building.

Theophilus Smith, 44, entered the plea to assault with a dangerous weapon Nov. 5 before Washtenaw County District Court Judge Carol Kuhnke. His other charge, assault less than murder, will be dismissed at sentencing.

He is scheduled to be sentenced Jan. 14 before Kuhnke. He has a sentencing agreement with the county prosecutor’s office, according to court records.

Assault with a dangerous weapon is a felony punishable by up to four years in prison.

Smith was charged with allegedly assaulting a 40-year-old woman Oct. 14, 2023, in the sixth-floor lobby of Miller Manor, 727 Miller Ave., police previously said. The woman was hospitalized with jaw injuries.

The attack was not random and the two knew each other, according to Chris Page, a police spokesman. Both were residents of the Ann Arbor complex at the time.

No weapon was used, police said. The attack was caught on surveillance footage.

Smith is being held in the Washtenaw County Jail.
