COLUMBUS, Ohio (WOIO) – The arrest warrant for a man who says police kidnapped a 13-year-old boy has been deemed “invalid” and he has been ordered released, WHIO reports.

On Nov. 8, police found 48-year-old Shane Smith in Springfield, Ohio, in Clark County, after canceling a statewide Amber Alert involving his 13-year-old stepdaughter.

Smith was found in a vehicle behind a home on Stanton Avenue in Springfield.

Police said the incident happened on South Huron Drive in Columbus around 10 a.m. on Nov. 8.

A court order filed Thursday ordered Smith to be released from jail because the arrest warrant filed in Franklin County was invalid, WHIO in Dayton reported.

Court documents revealed that the box designating the warrant as an arrest warrant was unchecked, according to WHIO.

While court documents describe this as “merely a technicality,” the original warrant was vacated, according to WHIO.

Columbus police may reissue an arrest warrant to bring Smith back into custody.
