Justice Yadav held that although the courts cannot exercise their inherent power in conflict with what has been specifically provided by a statute, when there is no such prohibition on granting interim relief under a statute, “such a power to grant interim measures might be considered”.

“In the light of the above, without going into the correctness of the challenged orders, the summons request is resolved, noting that the appeals authority has the competence to examine the petitioner’s suspension request, as is the case in the merits of the matter, ” said the Court.
