Donald Trump faces a legal abyss if he loses the election

The former president Donald Trump will face serious legal problems if he loses the presidential election, a legal analyst said Newsweek.

Greg Germain, a law professor at Syracuse University in New York, said Newsweek that Trump must win the presidential election to defeat federal charges. Trump faces charges in federal courts of election fraud in Washington, DC

He was facing charges of hoarding classified documents at his Florida home, but Judge Aileen Cannon dismissed the charges after ruling that the chief prosecutor, Jack Smithit was illegal under the Appointments Clause of the US Constitution.

Smith is appealing Cannon’s decision. If he loses, the Justice Department can appoint an internal prosecutor to lead the case, thus complying with Cannon’s ruling.

He also faces election fraud charges in Georgia.

“State non-criminal cases probably follow the same course whether he’s elected or not,” Germain said.

However, the Department of Justice has issued a written rule that presidents should not be prosecuted while in office. That means both state cases will likely be delayed until after Trump leaves office.
