Police Scotland said in a press release Thursday that Mastroianni surrendered voluntarily. The investigation found no other victims and it was an isolated incident.

Mastroianni, a member of the Rotterdam City Council, lost his race to incumbent Rep. Angelo Santabarbara in the district, which covers parts of Schenectady and Montgomery counties. Santabarbara got 59% of the vote compared to 36% for Mastroianni.

Schenectady County Democratic Committee Chairman Frank Salamone called on Mastroianni to resign from the board in the wake of the allegation. Salamone said this offense does not preclude a federal felony charge from being filed in the future.

“Not only did Mr. Mastroianni commit a crime on camera, but his refusal to offer an explanation for his actions — even at a press conference he scheduled — demonstrates his utter disregard for the public he claims to serve him. The city of Rotterdam deserves to be represented by someone who is not an unapologetic thief.” Salamone said the people of Scotland should be grateful to have a police department that “acted quickly to protect our elections and people’s privacy in their mailboxes.”

Santabarbara issued a statement saying he would decline further comment and would “trust that the case will proceed through the criminal justice system appropriately.”
