Teenager sentenced to up to 100 years in prison in Omaha gas station killing

OMAHA, Neb. (WOWT) – The 17-year-old is facing charges in connection with a January homicide at a central Omaha gas station, he appeared in court Tuesday.

Delvin Amaya, 17, of Omaha, was sentenced to 80 to 100 years for second-degree murder and using a firearm to commit a felony, according to court documents.

He pleaded “no contest” in court in September, and his charge of first-degree murder was changed to second-degree.

Four of his charges were previously dropped: two counts of second-degree assault and two counts of using a firearm to commit a felony.

Records indicate that at the time of its initial court appearance Delvin was previously due in court for a probation review in January on the manslaughter charges. He was 16 at the time.

The case involves third-degree assault and carrying a concealed weapon. Amaya was sentenced to indefinite probation in July 2020. He was held without bail.

His father, Mario Amaya-Castillo, 46, of Omaha, was charged as an accessory to murder and tampering with evidence.

Amaya-Castillo entered a plea in September to charges of attempted tampering with physical evidence and obstruction of government operations — both felonies.

He will be sentenced on December 3.
