As of 2022, abortion rights and abortion laws are no longer supported at the federal level, instead, abortion rights and laws are decided by state legislatures.

When the Supreme Court overruled Roe v. Wade in 2022, Louisiana quickly imposed a trigger ban that completely banned abortion, at all stages of pregnancy.

This trigger ban also included civil and criminal penalties on abortion.

Abortion Laws in Louisiana

Abortion is currently illegal in the state of Louisiana and has some exceptions to abortion lawsin fact, the state constitution explicitly excludes the right to abortion.

After his overthrow Roe v. Wadeand after the state’s trigger ban, Louisiana has not yet repealed other abortion laws.

State law continues to prohibit medical abortionprocedures to remove a fetus or the contents of a uterus, as well as abortions for reasons of disability after 26 weeks of gestation.

What’s more, the state still requires by law that pregnant people seeking abortion care must engage in a mandatory 72-hour waiting period, biased counseling and an ultrasound.

Moreover, these abortion laws prohibit public funding and private insurance. State law also requires a parent, legal guardian or parish judge to consent to the minor’s abortion.

According to the Center for Reproductive Rights, Louisiana state law contains no express constitutional or statutory protections for abortion.

In fact, according to the Center for Reproductive Rights, Louisiana voters approved an amendment to the state constitution in 2020 pointing out that the constitution does not protect abortion or require funding for abortion care.

What is the outlook for abortion rights and laws in Louisiana?

During this year’s presidential campaign season, both candidates included their position on abortion rights.

Democratic candidate Kamala Harris encouraged Democratic voters to clear the Senate’s legislative filibuster to pass a bill that would restore abortion protections nationwide.

Republican nominee Donald Trump takes credit for overturning Roe v. Wade because he nominated three of the Supreme Court justices who voted to overturn it in 2022.

In the past, Trump’s position on abortion has varied. At times, Trump has sided with banning abortion completely, and at other times, he has sided with banning abortion at the federal level.

For example, Trump said at the Danbury Institute’s Inaugural Life & Liberty Forum that abortion should be “entirely eradicated.” Then, a few months later, he went on to say in a social media post that he would veto any restrictions on abortion nationwide.
