Man charged with murder in Biddeford shooting makes first appearance

The second suspect in the death of a Biddeford man last month made a brief court appearance Thursday, but attorneys said little about his case.

Garret Labonte, 45, he was arrested Monday and charged with murder, murder and robbery in connection with the death of Gene Dares, 46, who was shot on Foss Street in late September.

Labonte appeared Thursday morning in York County Superior Court via Zoom. He didn’t have to enter a plea. He has not yet been indicted by a grand jury and will be held without bail. His lawyers could argue for bail at a future hearing.

Several of Dares’ family members tuned in to the brief hearing but did not speak.

Dares grew up in Biddeford, according to an obituary. He was a son, brother and father to three girls.

Labonte is one of two people facing charges for the death of Dares. Linda Lambert, 56, faces murder and robbery charges.

During her first appearance on Wednesdaya prosecutor suggested Lambert set up a fake drug deal so Labonte could kill Dares. Her attorney disputed that claim, suggesting Lambert may have been merely a witness to the murder, which attorneys say took place in front of her home.

Few details about the charges against Labonte were shared in court Thursday. Court records in both cases are still sealed from the public.

Labonte’s attorneys, Luke Rioux and Mark Peltier, and Assistant Attorney General Jennifer Ackerman spent about 20 minutes with Senior Judge Richard Mulhern in a Zoom chat room before the hearing began, during which Mulhern asked Labonte if he had time to talk to his lawyers and if he understood his rights.
