Augusta man charged with hitting, slapping and threatening woman

AUGUSTA — An Augusta man who allegedly punched a woman in the head, slapped her so hard she fell and threatened to kill her was charged Oct. 16 with domestic violence.

Dustin E. Gay, 41, of Augusta, was indicted by a Kennebec County grand jury on two counts of aggravated assault with domestic violence, two counts of assault with domestic violence and one count of criminal threatening domestic violence.

The woman he allegedly assaulted said he punched her in the head, slapped her so hard she lost her balance and fell and held a charging cable to her neck and said he will kill Police noted that when they interviewed her, she had a red mark on her neck and blood on her head around the earring and was limping, according to an affidavit filed by Augusta Police Officer Erik Maheu.

The woman also initially said that the man hit her with his car, injuring her leg. She later retracted her accusation in a statement to police and said he was following her in his car as she was walking and thought he was going to hit her. She said he stopped and tried to get her into the car and she took a step back, tripped and injured her ankle.

She later told police he punched her in the ankle.

One of the two Class B domestic violence aggravated assault charges Gay was charged with, however, still states that he “intentionally, knowingly or recklessly caused bodily injury” to the woman, “with the use of a weapon dangerous, a motor vehicle. .” A Class B felony is punishable by up to 10 years in prison.

The incidents allegedly took place on July 21 in Augusta after the two had been to several bars and restaurants in the city and argued, both while they were out and after returning home .

An indictment is not a finding of guilt, but it indicates that there is enough evidence to proceed to trial. Also indicted by a Kennebec County grand jury, which handed down its findings on Oct. 16, were:

• Dakoda M. Cole, 28, of Windsor, domestic violence aggravated assault, domestic violence assault and report of obstructing a crime or injury July 26 in Windsor.

• Brian J. Coutu, 35, of Augusta, unlawful possession of scheduled drug (cocaine base), operating after suspension, leaving the scene of an accident involving property damage and criminal operating under the influence.

• Daniel D. Cram, 41, of Clinton, unlawful possession of scheduled drugs (contain fentanyl powder), unlawful possession of scheduled drugs (cocaine base) and refusing to submit to arrest, July 1 in Waterville; and aggravated trafficking in scheduled drugs (fentanyl powder), unlawful possession of scheduled drugs (methamphetamine), violating conditions of release and unlawful possession of scheduled drugs (containing fentanyl powder), July 20, in Waterville.

• Veronica R. Davila, 23, of Augusta, escape, June 10, in Augusta.

• Albert Jonathan DiPietro, 39, of Jay, burglary, two counts of theft by unauthorized taking and criminal mischief July 5 in Rome.

• Sherry L. Gilley, 39, of Harpswell, unlawful possession of scheduled drugs (contain methamphetamine), unlawful possession of scheduled drugs (cocaine) and violation of condition of release Aug. 19 in Vassalboro.

• Nicholas C. Hunter, 46, of Waterville, theft by unauthorized taking, April 23 in Manchester; and theft by unauthorized taking, May 2 in Augusta; and theft by unauthorized taking, May 4 in Augusta.

• Misty Jean Ireland, 40, of Gardiner, aggravated trafficking in scheduled drugs (fentanyl powder) and unlawful possession of scheduled drugs (containing fentanyl powder) Aug. 13 in Waterville.

• Ronjan Johnson, 44, of Brockton, Mass., two counts of aggravated trafficking in scheduled drugs (fentanyl powder) Feb. 12 in Albion.

• Jaymie L. LaChapelle, 39, of Augusta, theft by unauthorized taking, March 2 in Augusta; and theft by unauthorized taking, March 4 in Augusta; and theft by unauthorized taking March 3 in Augusta.
